Abstract
Good faith is an abstract meaning and difficult to formulate, in the implementation of good faith agreements it becomes a principle related to the issue of decency and appropriateness. It is important to emphasize the lack of clarity on the principle of good faith, both among academics and practitioners, including judges who decide civil disputes in court. With the development of current contract law, in the pre-contract phase sometimes legal events have occurred which have caused losses to the party in the contract that will carry out the agreement. This paper discusses the position of the principle of good faith in the pre-contract phase which is related to the law enforcement system in an effort to uphold the function of upholding legal norms in a real way as a guideline for behavior in legal relations.
