Abstract
The study of gender perspectives in fiqh mu'asarah, brings out the need for a modern interpretation of gender equality within the context of Islam by examining the complex relationship between gender roles and Islamic teachings. The aim of this abstract is to summarize the main ideas and arguments on gender in Islamic law, emphasizing both conventional interpretations and contemporary uses. The research methodology for this article is using qualitative methods, which is using a research approach that is sourced from authority references such as article, journal as a primary reference. The first objective for this research is to analyze the concept of gender position in Islam based on interpretations of the Al-Quran and Hadith by exploring the ways in which these writings express the rights, obligations, and duties that are allocated to certain genders. Next, to explain the debate on the rights of men and women in the division of inheritance with traditional and contemporary perspectives that challenge or uphold these views nowadays. Lastly, to to justify the issues related to gender perspective in Fiqh Muasarah based on gender equity and transgender So, based on gender equity we need to know our responsibility as human that responsible for their actions and who receive the same treatment whether they receive praise or punishment for them and for transgender is Individuals who identify as transgender are those whose gender identification differs from the sex they were assigned at birth, from male to female. This study attempts to encourage educated discussions around female rights and duties in Islam by examining both classical and contemporary views.
