Abstract

Unauthorized building is always a problem in Malaysia, every local authority pays attention on the complaint and patrols that discover any unauthorized building works in their areas. Unauthorized building is where the building is constructed without authorization from the Local Authority such as Majlis Daerah and Majlis Bandaraya. The legislation that explain the action that need to be taken on the case is the Street, Drainage and Building act 1974 (Act 133). There is a long procedure that already implement in the local authority, it is start with the complaint or patrol by the enforcement officer and end with approval with condition or demolish. Commonly the owner of the unauthorized building will have to pay increased fee as a compound. The owner also can send letter of appeal is the want decreased the fee that is charge to them. As for the case study for this report is a restaurant, it builds an open dining area on the public reserves without authorization and consent from the local authority. The result from the investigation and meeting the structure need to be demolish and used umbrella concept or adjustable canopy that starts at 6pm for the open dining area. It is hoped that the public concerns and gather information regarding this matter, so they can avoid being compound by the local authority and disturbed their neighborhood and surrounding by constructing a structure not by following the law.
