Abstract
This research project analyzes the issue on refugees in Malaysia. It examines the suitability of the Immigration Act 1963 in handling refugee's issues and compare the legal framework in Japan with Malaysia as to how the government in Japan manage such issues. This research proposes that the government of Malaysia should develop a specific body which act as a government agency to monitor the refugees in Malaysia. Despite not being a signatory to the Refugee Convention 1951 and its protocols in 1969, the government of Malaysia should not delegate the obligation in handling the refugees solely on the United Nation High Commission of on Refugees (UNHCR). Thus, an effort to establish the specific body to monitor the refugees should be taken seriously as it is important for Malaysia to have a control over the national security.
