Abstract

On 30 to 31 January 2019, the Judiciary of England and Wales and Malaysian Judiciary jointly organised a workshop on effective case management for civil and criminal cases at the Palace of Justice, Putrajaya. The objective of the course is to use, modify, adopt and insert into the Malaysian judicial system the new concepts of best civil and criminal case management system as practiced in the UK. The event was officiated by Tan Sri Datuk Seri Panglima Richard Malanjum, Chief Justice of Malaysia, who invited lecturers from the Faculty of Law, UiTM to attend the course. The Rt Hon. Lord Justice Haddon-Cave explained about case management in civil proceedings. He pointed out the concept of overriding objective of dealing with cases “justly and at appropriate cost”. His Honour Michael Topolski, Queen’s Counsel, highlighted the best conduct of criminal trials and sentencing. Miss Alyson Sprawson, Legal and Policy Advisor to the Senior Presiding Judge of Judicial Office, emphasized better case management approach in a criminal trial. Civil and criminal procedures are among the final year subjects at the Law Faculty of UiTM. As such, the Dean, Dr. Hartini Saripan has encouraged Faculty lecturers to attend the said workshop. Encik Yunus Bin Abu Samah, Puan Mimi Sintia Binti Hj. Bajuri, Dr. Azhani Binti Hj. Arshad, Dr. Faridah Binti Hj. Hussain and Dr. Nadzriah Bt Ahmad represented the Faculty. Judges, judicial officers and lecturers from the Faculty of Law, UiTM were given the opportunity to do some exercises on case management for civil and criminal cases. The course aimed to maintain the confidence of the public. Besides that, the sessions focused on avoiding delay in handling cases and on evading unfair advantage to the parties.
