Issue 2: Fasakh due to darar
Marriage in Islam is a valid and noble contract, which aims to create tranquility, love, and mercy between husband and wife, as mentioned in Surah ar-Rūm verse 21: “And among His signs is that He created for you spouses from yourselves so that you may find tranquility in them, and He placed between you affection and mercy. Indeed in that are signs for people who reflect.” however, Islam as a realistic and just religion does not deny the reality that marriage is sometimes tested with serious conflict. When there is no longer mutual understanding, oppression occurs, or the objectives of marriage cannot be achieved, Islam gives space for couples to end the marriage contract lawfully through several means, among them talak and fasakh.
