Abstract

Slide presentation for "Hibah in contemporary context"

Issue 1: Giving hibah to non muslim issue in hibah
Issue 2: Giving conditional hibah

Hibah is one of the instruments of asset transfer in Islam that is based on the concept of love and sincerity, without expecting any return. However, the implementation of hibah often faces several contemporary issues, among which are giving hibah to non-Muslims and hibah that is accompanied by certain conditions (conditional hibah). Both of these issues raise significant fiqh (Islamic jurisprudence) debates among Islamic scholars, especially when it involves the relationship between Muslims and non-Muslims, as well as the principle of complete ownership (tamlik) in the hibah contract.
