Abstract

The title of our project is The Relevancy of Consent of Wali under Muslim Marriage at Modem Day. This research paper will explain about the opinion of various school of jurisprudence as Shafi'I and Hanafi regarding the issue, comparison between states and opinion, and conclude whether consent of Wali under Muslim Marriage at modem day still relevant or not. The purpose of this project paper is to analyzing the main sources which is Al-Quran and Sunnah, to analyzing the differences school of thought that consist of Shafi'I, Maliki, Hanbali and Hanafi, to analyzing the current position of our statute which is Islamic Family Law (Federal Territories) Act 1984 (act 303) and lastly determine whether the role of wali in nowadays are still relevance and practical to be practiced. For this paper project, we are conducted qualitative type of research that consist of library-based and Internet research. This procedure is very helpful as it us provides vast resources which are significant to the research
